However, we cannot guarantee the accuracy, precision or completeness of the information made available on this Site.

Consequently, we accept no liability :

  • any damage resulting from fraudulent intrusion by a third party leading to modification of the information made available on the Site.
  • and more generally for any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused as a result of access by any person to the Site, or the impossibility of accessing it, use of the Site and/or credit given to any information originating directly or indirectly from the Site.

Any order taken for a product presented in the online shop of the Sapone & Sens website is subject to the buyer's consultation and unreserved acceptance of these general terms and conditions of sale.

These general conditions of sale apply to all sales concluded on the www.saponeetsens.com website, subject to the specific conditions indicated in the presentation of the products.

ARTICLE 1: Purpose of the contract

This contract is concluded between SAPONESSENCE SAS, registered with the RCS of Aix en Provence 838 400 877, Intracommunity VAT number: FR15838400877, whose registered office is: 67 Cours Mirabeau F-13100 AIX EN PROVENCE, and a customer of the www.saponeetsens.com website owned by SAPONESSENCE.

These terms and conditions apply to all orders placed on the site. In the event of modification of these general terms and conditions of sale, the applicable general terms and conditions of sale will be those in force on the day of validation of the order by the purchaser.

ARTICLE 2: Products

The products offered for sale are described on the basis of information provided by the suppliers.

The photographs of the products are not contractual.

The customer declares that he/she has read and accepted the general conditions of sale prior to placing his/her order. Validation of your order therefore constitutes acceptance of the general terms and conditions of sale.

ARTICLE 3: Prices

Prices are quoted in euros, net of all taxes, excluding postage and packing. They take into account the VAT applicable on the day of the order. The prices invoiced are those in force at the time the order is placed.

In the case of an order delivered to a country other than mainland France, the customer is the importer of the products purchased. For all products shipped outside the French overseas territories or the European Union, the invoice is based on the price excluding tax. The customer is solely responsible for declaring and paying any customs duties or other taxes that may be payable in their country.

ARTICLE 4: Product availability

Available products appear on our site, accompanied by the words "available". In order to best meet our customers' expectations, the availability of our products is regularly updated on our website.

If you have ordered a product that is unavailable after your order has been validated, you will be informed immediately. We will then cancel your purchase. If the sum has already been debited, you will be reimbursed immediately.

ARTICLE 5: Delivery charges

Delivery charges are calculated according to total weight and destination. They are displayed before the order is validated.

ARTICLE 6 : Delivery

Delivery is made to the delivery address indicated by the customer when ordering on our site. Delivery times are given as an indication only. The risks are borne by the purchaser from the moment the products leave our premises.

In the event of delivery taking longer than thirty days, the customer may withdraw from the contract of sale.

In order to provide you with the best possible service and to adapt to your needs, Sapone & Sens offers three delivery methods for mainland France:

  • Delivery to a parcel relay - €4.95 inc. VAT to one of the shops nearest to your home within 2 to 4 working days.
  • Home delivery - €9.12 incl. VAT per order in mainland France: receive your parcel at home within 48/72 hours from Monday to Friday for all orders placed before 12 noon. For all orders over €45, delivery is free in mainland France..

Orders received from Monday to Friday (before 12 noon) are prepared the same day or the next working day.

Orders received on Saturday and/or Sunday are prepared on the following Monday or Tuesday.

Working days: Monday to Friday

Working days: Monday to Saturday, excluding public holidays.

ARTICLE 7: Payment methods

You may pay for your purchases on the Site by credit card, PayPal or bank transfer.

Payment by credit card is made online when the order is placed and is completely secure.

Payment by PayPal is made online when the order is placed. It is secured by PayPal and also allows you to make your purchases in complete security.

Once you have placed your order, we will reserve your product for you within 4 working days. If we do not receive the transfer within the specified time, we will be obliged to cancel your order. We require full payment for the order.

ARTICLE 8: Ordering

To place an order, the customer must be clearly identified. If you already have a customer account on our site, simply log in. If you do not have a customer account on our site, you will need to create one.

Confirmation of the order implies acceptance of these terms and conditions of sale and acknowledgement that you are fully aware of them.

Validated orders are binding on the customer as soon as confirmation of receipt of the order is sent by e-mail.

You will receive an e-mail confirming your order at the e-mail address you gave when creating your customer account.

Check the details and total amount of your order. Correct any errors before accepting your order.

The transfer of ownership of the product will only take place once your order has been paid for in full.

ARTICLE 9: Withdrawal

In accordance with Articles L. 121-16 et seq. of the French Consumer Code, customers have the right to cancel their order within seven working days of delivery.

Simply return your product to us in its original packaging, in perfect condition, within 15 calendar days of receipt.

Shipping and return costs are at the Customer's expense.

The right of withdrawal does not apply to products made to your specific specifications or to personalised products. Products that are perishable by nature, that cannot be returned (such as downloads) or that may deteriorate are also excluded from the right of withdrawal.

The goods must be returned to the following address, the cost of return being at your expense:

In order for our returned product to be marketable again, you undertake to return it to us in its original packaging and in perfect condition. The packaging may be opened and the item used as long as it is still saleable.

ARTICLE 10: Warranty and right to return the product (hidden defect or fault)

The customer benefits from the legal guarantee of conformity of the goods to the contract (Art. L-211-4 of the French Consumer Code) and the legal guarantee against hidden defects (Art. L1641 of the French Civil Code). The guarantees begin to run from the date of delivery of the goods ordered.

This guarantee is limited to normal use of the product.

If the lack of conformity is proven, the customer may obtain a replacement or reimbursement for the products within 30 days, in which case the cost of returning the products will be at our expense.

ARTICLE 11: Refund conditions and deadlines

Products are refunded in full. It will be made by bank transfer / PayPal / cheque as soon as possible and at the latest within 30 days from the date on which the right of withdrawal is exercised.

ARTICLE 13: Personal data

Certain information relating to the customer will be transmitted to the seller (i.e. surname, first name, address, postcode and telephone number) in order to enable the processing and delivery of the products ordered.

The site's commercial offers will be sent to the customer by SMS/email if no objection has been made. Customers may object to commercial offers at any time, free of charge, by logging on to their personal space or by post to 67 Cours Mirabeau 13100 AIX-EN-PROVENCE.

The site ensures that the customer's personal information is collected and processed with respect for privacy in accordance with the French Data Protection Act no. 78-17 of 6 January 1978.

In accordance with articles 39 and 40 of the law dated 6 January 1978, the customer has the right to access, rectify, delete and object to their personal data. The customer exercises this right via :

ARTICLE 14: Liability

In accordance with Article 1147 of the French Civil Code, we are automatically contractually liable to you in the event of non-performance or improper performance of the contract entered into.

However, our contractual liability cannot be engaged in the situations mentioned below:

  • force majeure ;
  • acts beyond our control;
  • The photographs/illustrations/images on our site have no contractual value. We cannot therefore be held liable for them.

The company may under no circumstances be held responsible for use that causes fire, poisoning or burns.

ARTICLE 15: Jurisdiction and applicable law

In the event of a dispute between the consumer customer and our company, French law shall apply.

Any dispute that is not settled by compromise shall fall within the exclusive jurisdiction of the courts of Aix en Provence.

ARTICLE 16: Intellectual property

All comments, images and illustrations on our site are exclusively reserved to us under intellectual property and copyright law, and any use is prohibited except for private use.

Without prior authorisation, any reproduction of our site, whether partial or total, is strictly prohibited.
